Turkey – New Shoe Labeling Regulation Published

The Regulation stipulates that at least one article of footwear in each pair shall have a label affixed to it, providing information on the materials which are used in the manufacture of primary elements of the footwear and which form the upper, the lining and the sock, and the outer sole of the footwear.

The information shall be indicated on the basis either of pictograms or of written indications as requirement, and this shall be done by printing, sticking, embossing or using an attached label.

The labelling shall provide information on the material, determined in accordance with the requirement, which constitutes at least 80% of the surface area of the upper, and the lining and sock, of the footwear, and at least 80% of the volume of the outersole. If no material accounts for at least 80%, information shall be given on the two main materials used in the composition of the footwear. For the indication of classification of materials used in the manufacture of the upper, no account shall be taken of accessories or reinforcements such as ankle patches, edging, ornamentation, buckles, tabs, eyelet stays or similar
attachments. The classification of the outersole, on the other hand, shall be based on the volume of the materials contained therein.

The Regulation provides that the labelling shall be visible, securely attached and accessible. The dimensions of the pictograms shall also be sufficiently large to make it easy to understand the information contained therein. The labelling cannot be of such a character as to mislead the consumer.It is also possible under the Regulation to provide additional information in the label.

Manufacturers are under the obligation of affixing the label as required by the Regulation and for the accuracy of the information contained therein. If the manufacturer is not established in Turkey, the authorised agent of the manufacturer and/or the importer shall be considered as the manufacturer within the meaning of the Regulation. In the event that these parties are not accessible, this obligation shall fall on the distributor.

The Turkish Ministry of Customs and Trade will carry out the inspection and supervision of the footwear in accordance with the Market Surveillance and Inspection Regulation published in the Turkish Official Journal, No. 29028, dated 12 June 2014. Non-compliance with the provisions of the Regulation may result in an administrative fine in the range of 2,000 to 5,000 Turkish Liras.accompanying the information required by the Regulation, should there be a need. However,the Regulation makes it clear that introduction of the footwear on the market cannot be prohibited on the grounds that such additional information was not indicated on the label.
