SDPPI Permen KOMINFO No. 3 Tahun 2024 Now In Effect!

Permen KOMINFO No. 3 Tahun 2024 was published on February 23, 2024, and came into effect on May 31,2024.

 

A summary of updates is listed below:

 

• KOMINFO will issue new regulations and it is expected that devices requiring an SDPPI certificate will be determined by HS codes.

 

• Additional applicants, such as state agencies, international organizations, and individuals, may apply for certification. Applications submitted by these parties must be for internal use only, and may not be for sale/commercial use.

 

• Low-Power Devices (with power below 10 mW) may apply for model variant/family certification. The certificate will state the model variant(s), and any future new family models require a separate application for approval.

 

• Switch/Router network devices are not eligible for series/family approval.

 

• Certification fees must be received within 14 days. If payment deadlines are missed twice, and a certificate has been cancelled in a calendar year, the SDPPI account may be frozen for 6 months (starting from the due date of the second unpaid fee).

 

• Certificates do not have a validity period. Products already in circulation may still be used, however for importation purposes a certificate may only be used for a maximum of 3 years from the date of issuance.

 

• Certificates may no longer be transferred to another party, and an application must be submitted for a new certificate.

 

• Certificate modifications may be made if done properly within the OSS system.

 

• SDPPI labels, QR codes, and warning labels must be affixed to devices and packaging. In the event this is not possible, they may be affixed to the manual and/or packaging, or digitally.

 

• Labels must be reported to the SDPPI system within 30 calendar days from the date the certificate was issued. A written warning in the form of a notification letter will only be given once. If the notification letter is ignored, the SDPPI account will be subject to a penalty of being frozen for 6 months.

 

• If labels are not attached when sending the products, the importer will receive a maximum of 3 warnings. If the 3 warnings are ignored, the SDPPI account will be frozen for 6 months.

• The QR Code may only be downloaded from the SDPPI system after the certificate is released, and the warning label and certificate number must be created separately. After May 23, 2024, the 3 files (QR Code, warning label, and certificate number) may be downloaded according to the Label Format attached to the regulation.

 

• The new labeling scheme only applies to certificates issued starting May 23, 2024. Certificates issued prior to May 23, 2024 are not required to follow the new regulation’s label provisions.

 

• Evaluation of the queue system for SDPPI applications is still being carried out.

 

• An SDPPI director will be appointed as soon as possible.

 

• Recognition of foreign labs under KEPDIR SDPPI No.109/2024 will be valid until the end of 2024. SDPPI will issue new regulations on the provision for determining foreign and domestic labs. According to the MRA road map, foreign labs can submit requests for the determination of overseas labs for the 2025-2026 period and will coordinate directly with SDPPI.

 

• Marketing names will be accommodated in the near future and may only be changed once the new regulation is in effect.
