Starting August 1st, 2019, Products subject to CMIM mark shall comply before arriving at the customs for clearance. Failing to do so may cause repeal of the shipment.
Up to now, Importers were allowed to affix the mark after clearing the goods. This shall not be permitted after August 1st, 2019.
As a reminder, CMIM Mark is mandatory for products that fall under the scope of the Moroccan LVD/EMC Directives. In general, those directives work in a similar manner as the CE LVD/EMC directives:
1. LVD directive applies if the device's AC power is in the range of 50-1000 Volts or the DC power is in the range of 75-1500 Volts.
2. No exemptions of Radio communication or Telecommunication Terminals from LVD directive if their power is in that range.
3. Radio communication devices and Telecommunication terminals are exempted from EMC directive
Back in Feb. 2019, Moroccan Customs published a list of products they will inspect at border for CMIM mark (The list provided by customs is not complete).
However, at realtime, we think that manufacturer is responsible to determine if his products fall under LVD/EMC directives and hence the need of CMIM marking.
CMIM marking is not the only obligations. Manufacturer also has the following obligations:
· Providing SDoC in arabic that relates to Moroccan Directives and Standards
· Holding the Technical File within Morocco for 10 years starting from his last shipment
While EMC/LVD directives have been around for two years now, their full implementation is going smooth. Not all obligations are enforced equally across all points of entry. At realtime, we encourage manufacturers to take all steps to comply with each provision of the directives without taking into consideration the enforcement status.
