India WPC authority has just issued new regulation that applying of ETA certificate is not required for all type of devices on 26th February, 2019. See below for the notification.

The importer / Authorised Indian local representative shall self-declare at India Custom. However, WPC Wing may carry out sample check / audit for the purpose of RF analysis / Spectrum monitoring during market surveillance.  

The new regulation is still under discussion on how this new regulation could be carry out as the custom officer refused to clear the shipments based on self-declaration on two grounds.

1. No parallel notifications issued from Customs against WPC notification, since custom ports are regulated by Indian custom law, till the time any instruction/procedure is not documented through custom Act, they are will not follow WPC instructions.

2. Custom officer are not technical trained and self-declaration will lead to fraudulent and wrong equipment being cleared.   

WPC is still in discussion with the custom, we’ll keep eyes on it and expect to bring you the latest update this week!
