Britain Divorced from the EU | Meanwhile, All EU NB in the UK Will Be Removed from the NANDO Database

On March 29, 2017, the United Kingdom submitted a notification of its withdrawal from the European Union in accordance with Article 50 of the Treaty on European Union. This also means that the EU's primary and secondary laws will no longer apply to the United Kingdom since March 30, 2019. Britain will become the "third country" of the EU.

 

1. The Impact on the Identity of Economic Operators

Economic operators include manufacturers, importers, distributors and authorized representatives. According to EU product legislation, importers are economic operators established in the EU who bring into their products on the EU market from third-party countries. Since the date of withdrawal, manufacturers or importers established in the United Kingdom will no longer be regarded as economic operators established by the EU. Therefore, an economic operator in the EU with 27countries is acting as a distributor before, but will become an importer of the EU after the UK withdrawal. The operator must comply with the specific obligations related to the importer, which is different from the distributor.

 

The authorized representative or person in charge in the UK will not apply the EU legislation from the date of withdrawal. Therefore, the manufacturer shall take the necessary measures to re-designate the authorized representatives and responsible persons from the date of withdrawal.

 

2. Impact on Conformity Assessment Procedures and Notified Body

In some product areas, EU legislation requires that conformity assessment procedures be conducted by a qualified third-party notified body. 

 

EU product legislation requires the establishment of a Notified Body in a member country designated by the member states. And allow the Notified Body to be responsible for the implementation of the EU product legislation requirements of the conformity assessment tasks.

 

Therefore, from the date of the UK's withdrawal from the EU, the UK Notified Body will lose its eligibility for the EU Notified Body and will be removed from the EUO's NANDO database, so that it can no longer perform the task of product conformity assessment.

 

If the economic operator holds a certificate issued by the British Notified Body prior to its devoiced from the EU, they are advised to re-applying for a new certificate issued by the EU notification agency or to arrange the transfer - based on the notification by the manufacturer. The agreement between the former UK Notified Body and the EU agencies - the documents and the corresponding certificates transferred from the former UK Notified Body to the EU Notified Body and then take over the responsibility of the certificate.
