CPSC Proposes to exempt testing of certain wood products

The Consumer Product Safety Commission(CPSC) proposed a rule to determine that third-part chemical testing on certain untreated and unfinished engineered wood products (EWPs) to demonstrate compliance with prohibitions on lead, phthalates and ASTM F963 elements would be exempt.

The testing exemption EWPs would apply to particleboard, hardwood plywood, and medium-density fiberboard, made from virgin wood or pre-consumer waste wood.

The rationale is that research of Toxicology Excellence for Risk Assessment(TERA) found that these products used in a children’s product, a children’s toy or a child care article do not contain prohibited amounts of the following:

1. total lead specified by Consumer Product Safety Improvement Act of 2008 (CPSIA) section 101;

2. six phthalates(DEHP, DBP, BBP, DINP, DIDP and DnOP) regulated by the CPSIA section 108;

3. eight soluble elements specified by ASTM F963, namely: antimony; arsenic; barium; cadmium; chromium; lead; mercury; and selenium.

The proposal was issued on October 13, 2017 and the CPSC will accept comments until December 27, 2017.
