On July 10, 2026, the Brazilian National Environmental Council (CONAMA) approved Resolution No. 516/2026, which restricts the use of certain hazardous substances in electrical and electronic equipment (EEE) sold in the Brazilian market. Its core requirements are similar to the EU RoHS, but also include additional local compliance obligations such as product registration, technical documentation in Portuguese, and labeling requirements.
1. Scope of Application
1)The resolution applies to electrical and electronic equipment sold within Brazilian territory.
2)Electrical and electronic equipment is defined as equipment that depends on electric currents or electromagnetic fields to perform at least one intended function, as well as equipment for the generation, transmission, transfer, and measurement of such currents and fields, with a rated voltage not exceeding 1000 V AC or 1500 V DC, including parts and components. Examples include household appliances, IT and telecommunications equipment, lighting equipment, consumer equipment, photovoltaic modules, power tools, toys and sports/leisure equipment, electro-medical devices, in vitro diagnostic instruments, electronic veterinary devices, monitoring and control instruments, and automatic dispensers.
3)The resolution does not apply to: national defense equipment, space equipment, large-scale fixed industrial installations, large-scale fixed facilities, means of transport for persons and goods, off-road mobile machinery intended for professional use, implantable medical devices, primary cells and batteries, and EEE specifically designed for research and development purposes and made available exclusively between companies or institutions.

3. Additional Requirements
1)National Registration: The resolution requires the Ministry of Environment and Climate Change (MMA) to establish and manage a "National Register for the Restriction of Hazardous Substances in Electrical and Electronic Equipment." Manufacturers and importers must register their products in the register and provide a self-declaration confirming compliance with the requirements or eligibility for exemptions.
2)Technical Documentation: Companies must maintain complete technical documentation (in Portuguese) to substantiate their self-declaration, and make it available upon official request.
3)Product Labeling: Products or their packaging must bear clear identification, including model, batch number, manufacturer/importer information (in Portuguese), and the "crossed-out wheeled bin" symbol.
