The European Commission officially published the General Product Safety Regulation (GPSR) (EU) 2023/988 on 23 May 2023. The regulation came into force on June 12, 2023 and will be enforced on December 13, 2024, replacing the old General Product Safety Directive (GPSD, 2001/95/EC). Directives 87/357/EEC and 2001/95/EC are repealed as of December 13, 2024.

Background to the new regulations:
The new regulations are designed to address the major societal changes that have impacted consumer product safety over the past two decades, such as increasing digitalization, new technology developments, and globalized supply chains. This modernized framework will ensure that only safe products are available to consumers, regardless of their origin, whether they are sold in stores or online marketplaces.
Scope of the new regulations:
This Regulation applies to products that are placed or made available on the market insofar as there are no specific provisions with the same objective under Union law which regulate the safety of the products concerned.
Where products are subject to specific safety requirements imposed by Union law, this Regulation applies only to those aspects and risks or categories of risks which are not covered by those requirements.
This regulation does not apply to pharmaceuticals, food, feed, etc.
New Regulatory Significant Changes:
The objective of the new General Product Safety Regulation is to ensure that all consumer goods on the EU market are safe. The Regulation provides consumers with a real safety net against product safety or risks not provided for in other EU legislation, more specifically, by:
• List key elements, such as the evolving nature of the product or the interconnectedness in the consumer product safety assessment;
• Improve product safety differences between online and offline sales;
• Establish online marketplace-specific product safety requirements to protect consumers from dangerous products sold through online marketplaces;
• Expand the obligation for all products imported into the EU without other harmonized standards directives so that there are EU economic operators responsible for product safety;
• Provide the necessary tools to national authorities to strengthen their enforcement powers;
• Ensure effective product recalls, such as by requiring direct contact with consumers and standardizing recall notices.
