Attention丨The European Union has issued a new battery Regulation (EU) 2023/1542!

On July 28, 2023, the Official Journal of the European Union officially promulgated Regulation (EU) 2023/1542 on batteries and used batteries, and repealed the Primary Batteries Directive 2006/66/EC. The new regulations shall be effective from the 20th day after the promulgation (August 17, 2023) officially entered into force.

Release background:

Since the draft of the EU's new battery regulations was released in December 2020, due to major changes in the content and control requirements of the new battery regulations compared with the original EU battery Directive, it has received great attention from battery manufacturers and upstream and downstream industries. After more than two years of soliciting opinions, discussions and amendments, the new EU battery regulation has finally been officially promulgated and will come into effect on August 17, 2023.


Scope of application:

The new battery regulation will apply to all types of batteries in the EU (except for military, aerospace, nuclear and other special uses). And according to the different use scenarios, the battery is divided into the following five types:

1.portable battery

• Sealed type

• Less than 5kg

• Does not belong to other types of batteries 

2. starting, lighting and ignition battery

• Used for vehicle ignition, lighting, or starting

Used as an auxiliary or backup battery in vehicles, other transport or mechanical transport equipment

• SLI battery

3. light means of transport battery

• Sealed type

• Less than 25kg

• Drive L-shaped vehicles

• Does not belong to electric vehicle batteries

• LMT battery

4. electric vehicle battery

• For hybrid or pure electric vehicle traction battery

• Batteries for L-type light vehicles, but weighing more than 25kg

• EV battery

5. industrial battery

• or batteries that are repurposing for industrial use

• or other batteries exceeding 5kg that do not belong to the LMT/SLI/EV


For these five types of batteries, the new battery regulations put forward detailed requirements from the following aspects:

- Sustainability and safety: including hazardous material limits, carbon footprint, recycled materials, performance and durability, battery detachable and replaceable, safety, etc. 

- Label information 

- Due diligence 

- Waste battery management 

- Battery passport 

- Green public procurement


Among them, the requirements for limiting the composition of hazardous substances are summarized as follows:

Identification and information requirements:

• General information: All batteries are accompanied by a label containing basic information about the battery, including manufacturer information, battery type, chemical composition, other harmful substances other than lead, cadmium, mercury, key raw materials and other 10 items;

• Capacity information: Rechargeable portable batteries, LMT batteries, and SLI batteries should be labeled with their capacity information;

• Separate collection symbol: garbage can logo, cadmium more than 0.002% or lead more than 0.004% of the battery should be added under the trash can logo corresponding chemical element symbol (at least 1/4 of the size of the trash can logo);

• Identification code: The battery should be attached to the identification code, for different types of batteries, the identification code contains different information, the identification code should be able to be recognized and read by universal code readers (such as handheld communication devices, etc.);

• CE marking and EU Declaration of Conformity: The battery should be affixed with the CE marking before it is placed on the market or put into use.


Important reminder:

The introduction of the EU's new battery regulations marks the upgrading of the EU's requirements for batteries to full life cycle control, which will have a significant impact on domestic battery manufacturers and upstream and downstream industries; At the same time, it also brings greater challenges to related enterprises.
