New Requirements for Product Safety in Europe!

On May 23, the European Commission published the new General Product Safety Regulation, overhauling product safety regulation in the EU. This new regulation aim to implement new requirements for bringing products to market, recalls and the online marketplace in the EU. With this the new GPSR repeals and replaces the previous existing General Product Safety Directive 2001/95/EC.

 

Here are some of the updated regulations:

 

1. New Reporting Requirements about accidents caused by a product.

- Manufactures are required to notify authorities of accidents caused by products via the Safety Gate System online portal once have knowledge of the accident.

 

2. New Requirements for Product Recalls.

- Manufacturers must offer one choice of these three options remedies under GPSR.

 a. Refund, b. Repair and c. Replacement.

 

3. New Requirements related to Risk Assessments prior introducing product to the market.

- GPSR introduces additional factors to be considered such as risk to vulnerable consumer (children include), Impact on the health and safety of different gender, the effect of software updates and predictive functions of products.

 

4. New Requirements for Non-harmonized or Non- CE-Marked products.

- GPRS requires non -CE- marked products to align with the requirements for CE- market products.

 

5. New Requirements for Online Offers and Online Marketplace reporting for accidents caused by products.

- GPRS requires online offers and products to display warnings or safety information to be affixed to the product or its packaging under  other EU product laws.

 

6. Penalties left up to Member States.

- The GPRS leaves penalty threshold up to the EU members states changing the original legislative proposal set a minimum/maximum penalties of 4 percent of annual turnover.

 

7. Representatives action allowed.

- Class actions for violations of the GPSR will be allowed.

 

This new GPRS will take effect in June 12, 2023 with an 18-months transition period until the new regulation takes full effect on December 13, 2024.
