Recently, several brands, retailers and manufacturers received 60-day notices of violation for allegedly containing bisphenol A (BPA) in sportswear made primarily of polyester and contain some spandex. Proposition 65 warning labels for the presence of BPA were not provided with these products when sold. 

BPA is a well-studied chemical, known to cause developmental and reproductive harm. It was added to the Proposition 65 list of chemicals in 2015. BPA is used to make polycarbonate plastic, PVC, epoxy resins and thermal paper. In addition, BPA may be used dye-fixing agents for polyester and polyamide textiles. BPA can also be used in spandex production for antistatic properties.

The 60-day notice of violation is a legal document that is served to businesses that have allegedly violated Prop 65 warning requirements. It usually results in settlement negotiations, which may result in the two parties having a settlement agreement with reformulation or defined concentration requirements.
