On August 19, 2022, The Ministry of Industry and Trade (MOIT) of Vietnam published a Draft Circular of new RoHS regulation which is called “National technical regulation on the restriction of the use of certain hazardous substances in electrical and electronic equipment.”

The main differences from previous RoHS regulation (Circular 30/2011/TT-BCT) are as below:

1. Four new phthalates would be added to the restricted substances;

2. The submission of a declaration of conformity to the authority would be required ;

3. The display of a conformity logo would be required;

4. The Appendix of the Draft Circular lists several categories of electrical and electronic appliances subject to RoHS type approval which includes:

IT and Telecommunications Equipment:

• Mainframes

• Minicomputers

• Printers and Printing Equipment

• Personal and Laptop Computers (including CPU, Mouse, Monitor, and Keyboard)

• Notebook Computers

• Notepad Calculators

• Copying Devices

• Electrical and Electronic Typewriters

• Pocket and Desktop computers and other devices for collecting, storing, processing, presenting or communicating information by electronic means

• Fax Machines

• Telex

• Cellular Phones

• Telephones

• Answering systems and devices that transmit sound, images, or other information by telecommunications

Monitoring Instruments:

• Smoke Detector

• Heating Regulator

• Thermostat

• Other monitoring and control tools used in industrial installations (such as those used in control panels)

The Draft Circular will come into effect on January 1, 2026.
