Introduction to China's Laws and Regulations Related to Children's Products

China's laws and regulations related to children's product safety include the "Product Quality Law of the People's Republic of China", "The Import and Export Commodity Inspection Law of the People's Republic of China", the "Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China", and the "Regulations of the People's Republic of China on Certification and Accreditation" ", "Compulsory Product Certification Management Regulations" and "Compulsory Product Certification Implementation Rules", etc. China currently implements a compulsory certification market access system for three types of children's products, including child bicycles/child tricycles/wheeled child conveyances/baby walking frames products, toy products and restraining devices for child occupants of power-driven vehicles.

Compulsory Product Certification for Toys (CCC Certification)

In order to protect national security, protect human health and safety, protect animal and plant life or health, and protect the environment, relevant products listed in the compulsory product certification catalog as required by the state must undergo compulsory product certification and be marked with the certification marks before they can leave the factory, sell, import or use in other business activities. Toy products are related to the immediate safety and health of children and have always been a product category under the strict control of the State Administration for Market Regulation. After adjustment and optimization, on April 28, 2020, the State Administration for Market Regulation issued Announcement No. 18 of 2020, stipulating four types of toy products that require CCC compulsory certification: electric toy products, plastic toy products, metal toy products, and ride-on toys.

Toy Compulsory Product Certification Type

The basic certification type for implementing toy compulsory product certification is: Type Examination + Surveillance.

Applicable Scope and Standards of Toy Compulsory Product Certification

The Following Children's Toy Products are not within the Scope of CCC Certification

1. Uncharged paper, bamboo, wooden, plush cloth, ceramic, glass, plaster toys (but the plastic or metal parts with independent play functions in the suit are still within the scope of the compulsory product certification catalog);

2. Uncharged mouth-action toys, teethers, water toys, inflatable toys, color clay or crystal clay and other soft modeling toys (but the plastic or metal parts with independent play functions in the suit are still within the scope of the compulsory product certification catalog);

3. Suitable for GB6675.11 swings, slides and similar activity toys for indoor and outdoor family domestic use, suitable for GB6675.12 toy scooters, suitable for GB6675.13 chemical toys (sets) other than experimental sets, suitable for GB6675.14 finger paint, suitable GB26387 Experimental sets for chemistry and similar activities;

4. Stationery with play function;

5. Toys to which the scope of the GB6675.1 standard does not apply and products that are not considered toys.

Certification Certificate and Certification Mark

The validity period of the certification certificate obtained after the toy compulsory product certification is 5 years. During the validity period, the validity of the certificate depends on the surveillance of the certification body to be maintained. The certified toy shall be equipped with the standard specification CCC mark or self-printed/molded CCC mark on the appropriate position of the product body or on the product label. For products that cannot have the CCC mark on the body, the CCC mark should be added to the smallest sales package. The CCC logo style is as below:
