On February 8, 2021, the Maine Department of Environmental Protection (DEP) draft report identified the following substances to be classified as food contact chemicals of high concern, and provided a basis for how these substances meet the toxicity conditions and exposure standards:

(1) Bisphenol A, Bisphenol B, Bisphenol S and Bisphenol F (combined into "bisphenol structure");

(2) 4-octylphenol;

(3) Octamethylcyclotetrasiloxane (D4);

(4) Toluene;

(5) Styrene;

(6) Benzene;

(7) Methylene diphenylamine;

(8)Propyl p-hydroxybenzoate, butyl p-hydroxybenzoate, methyl p-hydroxybenzoate, ethyl p-hydroxybenzoate (combined into "para-hydroxybenzoate structure");

(9) Benzophenone;

(10) Nonylphenol.

The deadline for comments on the draft list is March 10, 2021.

According to Maine’s Food Packaging Toxic Chemicals Act, once a substance is determined to be a food contact chemical of high concern, the state can require:

(1) Inform the state authorities in writing to disclose the relevant chemicals in food packaging;

(2) Complete the evaluation of substitutes for related chemicals;

(3) If it is considered that there are safer alternatives, the use of the substance in food packaging is prohibited.
