On September 1, 2020, the European Commission issued a draft (Ares(2020)4532780), which proposes to clearly stipulate the limits of pentachlorophenol and its salts and esters (hereinafter referred to as PCP) in Annex I of the POPs Regulation.

It is currently in the public consultation stage. The deadline for consultation is September 29, 2020.

In Part A of Annex I to Regulation (EU) 2019/1021, in the fourth column (‘Specific exemption on intermediate use or other specification’) of the entry for pentachlorophenol and its salts and esters, the following text is added: ‘For the purposes of this entry, point (b) of Article 4(1) shall apply to concentrations of pentachlorophenol and its salts and esters equal to or below 5 mg/kg (0,0005 % by weight) where they are present in substances, mixtures or articles.’.
