On 27 August, 2020, Australia registered ‘Consumer Goods (Toys Containing Magnets) Safety Standard 2020’ in the Federal Register of Legislation to update the mandatory safety standard for toys containing magnets. The mandatory standard includes a transition period of 12 months to assist with the changeover to the new mandatory standard:
• Up to 28 August 2021, suppliers have the option to comply with the requirements from either the ‘Consumer Goods (Toys Containing Magnets) Safety Standard 2020’ or the ‘Consumer Protection Notice No. 5 of 2010 (Consumer Product Safety Standard for Children's Toys Containing Magnets)’;
• From 29 August 2021, suppliers must only comply with the requirements in the ‘Consumer Goods (Toys Containing Magnets) Safety Standard 2020’.
According to the new standard, toys containing magnets must comply with the relevant sections of one of the following standards:
• Australian/New Zealand Standard AS/NZS ISO 8124.1:2019 Safety of toys Part 1: Safety aspects related to mechanical and physical properties
• European Standard EN 71-1:2014+A1:2018 Safety of toys - Part 1: Mechanical and physical properties
• International Standard ISO 8124-1:2018 Safety of toys – Part 1: Safety aspects related to mechanical and physical properties
• US Standard ASTM F963 - 17 Standard Consumer Safety Specification for Toy Safety.
The mandatory standard applies to toys that are supplied:
• New and are designed or clearly intended for use in play by a child under 14 years of age; &
• With one or more magnets or magnetic components.
However, this standard does not apply to the following:
• Sporting goods
• Camping goods
• Bicycles
• Home and public playground equipment
• Trampolines
• Electronic game units
• Models powered by combustion or steam engines
• Fashion jewellery.
