Washington Toxic-Free Kids and Families Act Implemented

In order to reducing public health threats, Washington state's House of Representatives passed the Toxic-Free Kids and Families Act (HB 2545) on 15 February 2016. Beginning 1 July 2017, no manufacturer, wholesaler, or retailer may manufacture, knowingly sell, offer for sale, distribute for sale, or distribute for use in this state children's products or residential upholstered furniture containing any of the following flame retardants in amounts greater than 1,000 parts per million in any product component:

 

TDCPP, TCEP, DecaBDE, HBCD and TBBPA. The following table for details:

Products Scope

  1. 1.Toys;

  2. 2.Children's cosmetics;

  3. 3.Children's jewelry;

  4. 4.A product designed or intended by the manufacturer to help a child with sucking or teething, to facilitate sleep, relaxation, or the feeding of a child, or to be worn as clothing by children;

  5. 5.Portable infant or child safety seat designed to attach to an automobile seat;

  6. 6.Residential upholstered furniture.

 

A separate provision in the act will require the Department of Ecology to consider listing six additional flame retardants as chemicals of high concern to children:

  1. 1.IPTPP (isopropylated triphenyl phosphate);

  2. 2.TBB ([2-ethylhexyl]-2,3,4,5- tetrabromobenzoate);

  3. 3.TBPH (bis [2-ethylhexyl]-2,3,4,5- tetrabromophthalate);

  4. 4.TCPP (tris [1-chloro-2-propyl] phosphate);

  5. 5.TPP (triphenyl phosphate);

  6. 6.V6 (bis[chloromethyl] propane-1,3-diyltetrakis [2-chloroethyl] bisphosphate).
