On August 25, 2016, EU published COMMISSION REGULATION (EU) 2016/1416 amending and correcting Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food. After COMMISSION REGULATION (EU) No 10/2011 was published, it had 7 amendments, the revised version of the previous 6 amendments are in the Annex 1 of the EU10/2011 regulations to amend the list of authorized substances. The revised regulations (EU) 2016/1416 is different, the revised content are more. It clarifies and corrects some definitions, and readjusted and added migration restrictions of heavy metal on the plastic and specific test conditions, and also updated the list of authorized substances in Annex 1.

Coming into Force

※ Regulation(EU) the 2016/1416 new law does not need to be converted to the laws of the EU member, after the regulation was released 20 days, the regulation come into force directly. That is, the regulation come into force on September 14, 2016, in addition to the following special provisions of the regulations.※ Annex II add the migration limit of aluminum, revised migration limit zinc and table 2 in Annex III for fresh or chilled fruit and vegetable food simulation solution. These two part will come into force on September 14, 2018.

※ The regulations have an implementation of the buffer period, for plastic materials and products are accord with (EU) 10/2011, it can continue to put on the market until September 14, 2017, and can be finished in stock.

Amendments

※ Update “non fat food” and “specific” definition, and add “hot-fill” definition in the regulation (EU)10/2011. Add clause 11(4) and update terms 6(3)(a)、11(3)(a)、11(3)(b)、13(3)、17(3)、18(a)、18(b).

※ Amend and add the list of authorized substances in table1 Annex I, amend 7 kinds of materials allowed to use, and add 10 kinds of materials allowed to use.

※ Remove the clause 11(2) " The specific migration in food or food simulant shall not exceed 60 mg/kg ".

※ Add annex II migration limit of aluminum, and amend migration limit of zinc.
